Bypassing the Bureaucracy: How to Avoid a Town Planning Application.

Whilst JREY specialises in obtaining planning permits and believes in the process of planning applications, we understand the bureaucratic hurdles associated with town planning applications, also known as development applications (DAs), can be daunting.

There are ways to navigate the process more efficiently and even avoid the need to lodge a DA altogether, however, please be aware that in some cases it is not possible to avoid the need to go through development assessment to obtain approval.

Research Local Zoning Regulations

Before you even start planning your project, familiarise yourself with your local zoning regulations. These regulations dictate what can and cannot be built in specific areas. By understanding these rules early on, you can tailor your project to align with local zoning requirements, reducing the likelihood of needing a DA.

Consider Exempt Development

Some minor projects may qualify for exempt development, which means they don't require approval at all. These are typically small-scale alterations or additions that have minimal impact on the surrounding area. Examples might include garden sheds, fences, or minor interior renovations. Check with your local planning authority to see if your project qualifies.

Engage with Pre-Application Consultations

Before you get too deep into your project, consider engaging in pre-application consultations with your local planning authority or a private town planner. They can provide valuable insights into potential challenges, suggest modifications to your plans, and help you navigate the approval process more efficiently. Be clear that you would like to avoid a town planning approval application if possible.

Use Existing Structures

If you're looking to expand or adapt an existing structure, consider repurposing or refurbishing it instead of building something entirely new. Alterations to existing structures often have fewer regulatory requirements and can be a cost-effective way to achieve your goals without the need for a DA.

Be Mindful of Heritage Restrictions

If your property is in a heritage-listed area, there may be stricter regulations governing what you can do with it. There may however be a list of renovations or works you can do with an exemption certificate rather than going through a full development application process.

Utilise Fast Track Processes

Many regions in Australia offer fast track assessment alternative to traditional DAs. Whilst not 100% avoiding an application, specific types of development that meet predetermined criteria may qualify for cheaper Council fees. They are designed to streamline the process for straightforward projects like small home renovations and extensions. If your project fits the criteria, this can save you time.

Conclusion

While navigating the world of town planning applications and development approvals can be challenging, it's not always inevitable. By conducting thorough research, engaging with local authorities, and considering alternative pathways, you can significantly reduce the need for a town planning application. Remember that seeking professional guidance from a private town planner or consulting with your local planning authority can be a valuable step in making your project a reality without unnecessary bureaucratic hurdles.
